Gentleheat Subscription Service: terms & conditions

Customer agreement

I have read and agree to the following:

A This agreement covers the provision of the gentleheat subscription plan which I have purchased on the date stated on my order acknowledgement.

B This agreement is for a subscription period of 18 months.  If I end the agreement before the end of the subscription period, I must still pay all the subscription charges until the end of the subscription period.  This applies when this agreement comes to an end, except:

In these situations I don’t have to pay all the subscription charges until the end of the minimum period. However, I may still have to pay for my Gentleheat starter pack.

C Charges. I’ll pay all charges due under this agreement. I must pay by paypal recurring payment.  If my Gentleheat equipment is lost, damaged or stolen, I’ll still have to pay all the subscription charges during  the subscription period.

D Making a payment for my Gentleheat starter pack. If this agreement ends before the end of the subscription period and I have to pay for my Gentleheat starter pack, the original value on which the Gentleheat starter pack is based is £80.00.

The payment will be 1/18 of the original value of the Gentleheat Starter Pack equipment, i.e. £4.45, multiplied by the number of months left until the end of the minimum period.

This payment will need to be paid before the subscription can be stopped.

As an example: if the agreement ended 6 months prior to the end of the 18-month subscription period, then 6 months x £4.45 = £26.70 would be payable in respect of Gentleheat equipment.

E, Personal Data. Gentleheat may use my personal information, as described in clauses 11 and 13, to analyse the service Gentleheat provides and for marketing purposes.

Terms & Conditions

We, our or us – Gentleheat Limited.

You or your – the customer whose name appears on the order form.

Agreement – these conditions, and the subscription plan.

Charges – charges for products and services which we provide under the subscription plan.

Subscription Period – the 18 month Gentleheat subscription period.

Gentleheat equipment – your Gentleheat Starter Pack, including: Controller; Charger, Neoprene Belt.

 

1 Your Subscription period

The subscription period is 18 months from the date of purchase stated on your order acknowledgement.

If this agreement ends before the end of the subscription period (whether by you or us), you must still pay all the monthly subscription plan charges, until the end of the 18 month subscription period.

This applies when this agreement comes to an end in clause 9, except if:

 

2 Subscription content and services

You are entitled to benefit from the following (at a minimum), during the subscription period:

 

3 Using the services – the rules

a) It’s your responsibility to make sure you keep to this agreement, even if someone else is using your Gentleheat equipment.

b) You’re not allowed to sell all or any part of our product or services to anyone else.   The product and services must only be used for your personal, non-commercial use.

4 Payment

a) You must pay your bill by paypal recurring payment. VAT will be included if it applies.

b) If you owe us any money beyond your due date, and you do not have valid reasons for disputing the payment, we may charge you interest. We charge interest daily at the rate of 2% above the base rate of Barclays Bank each year. We may charge you reasonable administration costs as a result of you paying your bill late or failing to pay it.

5 Loss or theft of your Gentleheat equipment

In the event of your Gentleheat equipment becoming lost or stolen, you must continue to pay all the plan charges during  the subscription period.

We therefore strongly recommend that you take steps to insure your Gentleheat equipment against loss or theft with your own contents insurance provider.

6 Controller repairs under this agreement

In the event that you require to return your Gentleheat controller to us for repairs under this agreement, please post it to us at the address below.

We urge you to use ‘signed for’, insured delivery when sending items for repair to us, since we cannot be held responsible for any items which may get ‘lost in the post’, and you would remain responsible for paying all subscription charges due under this agreement in that scenario.

 

Remember to always include the following information inside your package, so that we know who the package has come from:

 

 

It is our aim to post your repaired controller back to you as quickly as possible, and normally this will occur within 2 weeks of our receipt of the broken controller.

However, this timescale may occasionally vary due to circumstances beyond our control – for example, the availability of spare parts, or postal delays/strikes.   In the event that we expect your repair will take longer than 2 weeks to effect, we will endeavour to make you aware of the expected timescale.

In situations where you have not received your repaired controller within 4 weeks of sending the broken controller to us, we will consider an application for a pro-rata refund of subscription fees, in respect of the period during which you were unable to have the continued enjoyment of the product.    The pro-rated refund will not exceed the subscription payment ordinarily due in respect of the period concerned, and Gentleheat’s decision will be final.

Please write to us at the address below should you wish to make an application for a pro-rated refund in the circumstances described above.

Please include a copy of your proof of postage (retain the original), and ensure to state your name, address and subscription reference number.

7 Changing charges and terms

We may change or withdraw services at any time and we may change or introduce new terms to this agreement at any time.

If we do, we’ll give you at least 30 days’ notice of these changes unless we believe such changes will not disadvantage you.   If these changes are to your material detriment, you will have a right to end this agreement under clause 9b and we’ll tell you if you do.

8 Suspending our services

a) We can suspend your use of the subscription service if:

 

b) We will try to tell you when we suspend or restrict your use, but we do not have to.

c) When we suspend or restrict your use, this agreement will continue and you still have to pay all charges due during any period when we suspend or restrict the service.

9 Ending this agreement

a) Either you or we may end this agreement by giving the other 30 days’ notice in writing. Your notice must include your subscription reference number together with your name and address.

b) You may end this agreement by writing to us if:

In these three situations you do not have to pay all the subscription plan charges until the end of the 18 month period.

 

However, you will still have to make a payment for your Gentleheat equipment.  

 

The original value on which the Gentleheat starter pack is based is £80.00.

 

The payment will be 1/18 of the original value of the Gentleheat Starter Pack equipment, multiplied by the number of months left until the end of the minimum period.   This payment will need to be paid before the subscription can be stopped.

 

 

10 Liability and exclusions

a) We will not be legally responsible to you for:

 

We will not be legally responsible to you if we cannot provide the subscription service because of something outside of our reasonable control, for example, postal service strikes or delays.

b) The terms of this agreement will not affect any rights which you may have under any law and which we cannot exclude under any agreement.

12 Debt and fraud-prevention agencies

a) If you don’t pay us in full, and on time, we may tell credit-reference agencies who will record the debt.  We may also use any information we hold to trace debts.

b) If false or inaccurate information is provided and fraud is identified, details will be passed to fraud-prevention agencies. Law-enforcement agencies may access and use this information.

13 General

a) We may transfer this agreement to anyone at any time. You may not transfer this agreement.

b) If you or we fail to enforce our rights under this agreement, it will not prevent you or us from taking further action.

c) A person who is not a party to this agreement has no right to benefit under or to enforce any terms of this agreement.

d) We may send you notices by post, voicemail, text or other form of electronic message and will assume for notices by post that you have received them 48 hours after we have sent them.  We’ll send all notices served by post, to the address which you have given. You must tell us about any changes to your address. If you want to contact us, please write to us at the address below.   You can then assume we have received these notices 48 hours after you have sent them.

f) If you have a complaint, please write to us at the address below. We will do our best to fix your issues.  You or we may bring legal proceedings in a court in Northern Ireland to resolve a dispute under this agreement.

g) This agreement is  governed by  the law of Northern Ireland.
